In the second of The Rights Don’t Retire videos, Brian tells of his experience running up against the WSIB’s age-related rules. A mason for over 40 years, he was 63 years old when he got injured on the job in a fall from scaffolding, which resulted in him having to undergo multiple surgeries.
Because he couldn’t go back to his pre-injury job on account of his injuries, he started re-training courses provided by the WSIB. But since the law says that a worker can only get up to two years of lost wages compensation if they are 63 or older when they are injured, his compensation was stopped as well as his retraining after two years, even though he wanted to keep working into his 70s. As a result of the current law, Brian hasn’t had employment income since 2023.
“I thought that when you got hurt, as long as you were seriously hurt, that the WSIB had your back. Now going through it all. I see all these loopholes that they seem to have…”
